The K-3 Nonimmigrant Visa


The K-3 visa is a nonimmigrant visa that allows you to travel to the US while waiting for your immigrant visa petition to be approved.



You can also apply for employment authorization while you're in the United States.

A K-3 is valid for two years. In order to obtain the visa, you must complete a DS-160 application form online. Once your application is submitted, you will be given a confirmation page that has a barcode.

You will need to pay a fee of $265 to apply for the visa. The fee is usually paid at the time of your interview.

After your visa has been issued, you can enter and exit the US as long as it remains valid. If you need to extend your stay, you must file an extension of stay form.

As a K-3 visa holder, you can enter and exit the US as often as you like. However, you cannot change your status to a different nonimmigrant visa while you're in the US.

The K3 visa is intended for foreign spouses of U.S. citizens who are legally married.

Before a K3 visa can be issued, the United States Department of State must confirm that the marriage is legal.

It can be denied if the relationship is not legitimate or there are other conditions preventing it from being recognized as a marriage. There are also a few conditions that can prevent a K3 from being issued, including criminal records.

Applicants for the K-3 visa must complete the DS-160 and submit the required documents. They should also bring a valid passport.

Usually, the applicant's fee will be paid during the interview, but the payment can also be made online.

Depending on the country, the embassy may require a medical examination. The embassy will send you instructions on how to finalize the application.

Once the DS-160 is completed, you should print out the confirmation page. When you go to your appointment, you will be asked to present this page.

Your interview will be held at the US Embassy or Consulate in the country where your marriage took place.

Generally, the interview is scheduled for four to six weeks from the date you corresponded with the embassy. This is because the embassy needs to receive the completed Form I-129F and other supporting documents from the U.S. Citizenship and Immigration Services (USCIS).

The USCIS approves your K-3 visa petition, but it will be forwarded to the National Visa Center (NVC) to be processed.

NVC will perform a security check on the petition, and it will then be forwarded to the US Embassy in the country where the marriage took place.

If the embassy is not able to process your application within 24 hours, it will notify you. You should then take the form and a copy of your passport to the embassy. They will then issue you a receipt notice. Then, you can begin the process of applying for a green card.
